Workers Doubt Impartiality of Independent Team in Revising Manpower Law


The Confederation of Indonesian Prosperous Trade Unions (KSBSI) doubts the impartiality of the independent team formed by the government whose duty is to review the revised Law No.13/2003 on Manpower.

The reason for the workers’ doubt is because the review was not their initiative, but the government’s.

“The review is a project that is being out-sourced to the independent team,” said Rekson Silaban, KSBSI Head, in Jakarta yesterday (30/5).

The team set up by the government comprises five universities, the University of Indonesia, Gadjah Mada University (UGM), Hasanuddin University (Unhas), Padjadjaran University (Unpad), and North Sumatra University (USU).

Rekson is concerned that the review results will be pro-government because it employs the independent team.

He questioned why the five universities do not take any initiative prior to the government asking them.

Rekson is also questioning the involvement of the University of Indonesia which he considers as unnecessary.

He is of the opinion that the University of Indonesia should be reviewing other laws which are more important, such as the law on the state-run social security service (Jamsostek), the investment law, the manpower monitoring law, or the salary law.

“Those are many more significant matters than these revisions,” said Rekson.

In response to the workers’ doubts, the independent team head, Armida S. Alisjahbana, said that the team is neutral.

“We don’t have any other interests,” he said.

These five universities have become team members, he said, because they are state universities.

Armida stated that the team was a combination of five universities and each university did not stand alone.

Fourteen experts in economics, law, and sociology will evaluate the manpower aspect, and so the review will be global.

“It’s not just about the manpower law revisions,” he said.

For a throughout review, said Armida, the team does not only study the law scripts, but also will carry out research in the field by watching the situation of workers in factories.
